TOPIK BUDDY TERMS OF SERVICE
CHAPTER 1: GENERAL PROVISIONS
Article 1 (Purpose)
The purpose of these Terms of Service (the “Terms”) is to set forth the conditions and procedures for using the AI-powered customized Korean language learning platform ‘TOPIK BUDDY’ (the “Service”) and all related features (AI level diagnosis, customized curriculum, question bank, AI-assisted correction, etc.) provided by KOYLABS Inc. (the “Company”), and to define the rights, obligations, and responsibilities between the Company and the User.
Article 2 (Definitions)
- “Service” refers to all features provided through the TOPIK BUDDY platform, including TOPIK past exam content, AI level diagnosis, customized curriculum, smart incorrect answer notes, and more.
- “Member” refers to an individual who agrees to these Terms and uses the Service.
- “Account” refers to the user account created based on the Member's existing social media credentials (Google, Apple, etc.) for the purpose of logging into the Service.
- “Content” refers to all educational materials provided by the Company, including question banks, AI-generated explanations, videos, text, and images.
- “Subscription Membership” refers to a paid service where a Member pays a regular recurring fee or installment to grant access to specific premium features or content for a set period.
Article 3 (Effectiveness and Amendment of Terms)
- These Terms shall become effective upon being posted on the platform's initial screen or linked screen.
- The Company reserves the right to amend these Terms. In the event of an amendment, the Company will announce the reason and effective date at least fifteen (15) days in advance. However, for amendments that significantly impact or disadvantage the Member's rights and obligations, notice will be provided at least thirty (30) days in advance.
- Members have the right to disagree with the amended Terms, in which case they may stop using the Service and terminate their account. Failure to express explicit refusal before the effective date shall be deemed as consent to the amended Terms.
Article 4 (Rules Outside the Terms)
- If separate terms or policies exist for specific individual services, those provisions shall prevail over these Terms.
- Matters not specified in these Terms shall be governed by relevant laws and general commercial practices.
CHAPTER 2: SERVICE CONTRACT AND INFORMATION MANAGEMENT
Article 5 (Execution and Rejection of Service Contract)
- The service contract is executed when a Member agrees to these Terms, completes the social media integration and learning history survey, and the Company approves the application.
- The Company may refuse approval or terminate the contract if the Member:
- Provides false information or misappropriates another person's identity.
- Has a history of being restricted from the Service.
- Applies for membership with fraudulent or abnormal intent.
Article 6 (Modification of Contract Information)
Members must promptly update their personal information, target TOPIK level, and exam date (D-Day) through the platform. The Company is not liable for any disadvantages resulting from the Member's failure to update such information.
Article 7 (Privacy Protection)
- The Company collects the minimum necessary information in accordance with the Information and Communications Network Act and other relevant laws, and obtains consent from the Member.
- Detailed matters regarding privacy protection, destruction of data, and the use of anonymized learning data are governed by the Company's separate Privacy Policy.
Article 8 (Member Account and Security Obligations)
- The Member is solely responsible for managing their linked social media accounts.
- Members shall not transfer or lend their account to a third party.
- If a Member recognizes that their account has been stolen or is being used by a third party, they must immediately notify the Company and follow its instructions. The Company is not responsible for losses incurred by failing to do so.
CHAPTER 3: USE OF SERVICE AND OBLIGATIONS OF PARTIES
Article 9 (Provision and Modification of Service)
- The Company provides services such as predictive score analysis, question banks, and customized curricula 24/7 via the mobile application.
- The Company may provide essential software updates (including the addition or removal of features) to improve service quality.
- When using the Service via a mobile network, separate data communication charges may apply, which are the sole responsibility of the Member.
Article 10 (Temporary Suspension of Service)
The Company may temporarily suspend the Service for maintenance, replacement, or failure of communication systems. In such cases, the Company will notify Members in advance, except in unavoidable circumstances where post-notification may be provided.
Article 11 (Member Obligations)
Members shall not engage in the following activities:
- Registering false information or stealing other people's accounts.
- Unauthorized capturing, recording, duplicating, or distributing of Content.
- Using abnormal macros (abusing) or circumventing technical protection measures.
- Using the Service for commercial purposes without the Company's prior consent.
*If a Member violates these obligations, the Company may take immediate action, including warnings, temporary suspension, permanent ban, or termination of the contract. The Company may also seek civil or criminal damages for business losses or copyright infringement.*
Article 12 (Company Obligations)
- The Company shall do its best to provide stable service and take measures to protect the personal information of Members.
- The Company shall respond faithfully to legitimate opinions or complaints raised by Members.
Article 13 (Copyright and Content Use Restrictions)
- The copyrights for the Service and its Content (modified past questions, original questions, AI explanations, etc.) belong to the Company or the respective right holders. Members may not reproduce or distribute them for commercial purposes without prior consent.
- Members are strictly prohibited from posting information obtained through the Service on the internet or providing it to third parties without authorization.
Article 14 (User-Generated Content)
- Content posted by Members within the Service (community, inquiries, etc.) must not defame others or infringe on copyrights.
- Any posts made by Members are deemed to grant the Company a perpetual, royalty-free license to use such posts for the purpose of operating, improving, and promoting the Service.
CHAPTER 4: SUBSCRIPTION MEMBERSHIP, PAYMENT, AND REFUNDS
Article 15 (Fees, Payment, and Promotions)
- Paid plans (Subscription Membership) are generally based on a Monthly Subscription or installment/lump-sum payments tailored to the target exam date.
- The Company may apply Tiered Pricing by country, considering global purchasing power and the willingness to pay in different regions.
- The Company may offer free trials and discount promotions according to event regulations to encourage premium conversions.
Article 16 (Payment Method and Taxes)
- Subscription purchases are made through the in-app payment systems provided by Apple or Google.
- Prices are displayed in USD or local currency depending on the Member's location. Sales tax, GST, or VAT may be included or added at checkout.
- The Company may adjust pricing prior to payment to reflect significant exchange rate fluctuations.
Article 17 (Termination and Refund of Subscription Membership)
- If a Member cancels their recurring subscription, benefits will remain active until the next scheduled renewal date. Automatic billing will cease thereafter.
- Subscriptions purchased through Apple or Google cannot be refunded directly by the Company and are subject to the respective platform's refund policy. The Company is not responsible for these third-party policies.
- Members must request refunds directly from the respective platform operator (App Store or Google Play).
- Unless mandated by law, the Company does not provide pro-rated refunds for the remaining period of a subscription.
CHAPTER 5: SPECIAL PROVISIONS FOR TOPIK BUDDY
Article 18 (AI-Based Level Test and Diagnosis)
- The Company provides an AI diagnosis service that analyzes predicted scores and weak areas for efficient learning.
- These diagnostic results are provided for reference only and do not guarantee the same results in the actual TOPIK exam.
Article 19 (Customized Curriculum and Question Bank)
- The Company provides paid Members with a daily curriculum linked to their level and D-Day, along with unlimited access to the question bank.
- Members can receive recommendations for similar questions based on their weak points through smart incorrect answer notes.
Article 20 (AI Writing Correction and Feedback)
Certain premium Members (e.g., VIP) may receive AI-powered correction and feedback for their written TOPIK answers.
Article 21 (AI Features and Scope of Liability)
All AI-based features, including level tests, error analysis, explanation generation, and writing corrections, may contain technical errors or hallucinations. The Company shall not be held liable for limitations in learning outcomes resulting from these factors, unless caused by the Company's intentional misconduct or gross negligence.
CHAPTER 6: TERMINATION AND MISCELLANEOUS
Article 22 (Termination and Restriction of Use)
- Members may terminate their account at any time within the Service settings.
- The Company may restrict use or terminate the contract without prior notice if a Member violates these Terms (e.g., account sharing, hacking attempts, unauthorized data extraction).
Article 23 (Disclaimer and Limitation of Liability)
- The Company is exempt from liability if it cannot provide the Service due to force majeure, such as natural disasters.
- The Company is not liable for service interruptions caused by the Member's own fault (mobile device errors, network failure, etc.).
- To the extent permitted by law, the Company shall not be liable for indirect, special, or punitive damages, nor shall it provide time-proportional compensation for service interruptions.
Article 24 (Prohibition of Assignment)
Members may not assign, gift, or provide as collateral their status or rights and obligations under these Terms to any third party.
Article 25 (Notice and Announcement)
- The Company notifies Members via in-app push notifications, banners, or pop-ups.
- Announcements for all users shall be deemed effective after being posted in the Service's notice section for at least seven (7) days.
Article 26 (Governing Law and Jurisdiction)
- Any legal disputes arising between the Company and the User shall be governed by the laws of the Republic of Korea.
- The court of first instance for any dispute shall be the court having jurisdiction over the Company's registered address.
